1 Protecting your Privacy

In the following, we inform you which data Pixzam (Germany limited liability company, Immanuelkirchstr. 37 Berlin, FED REP Germany 10405, hereinafter referred to using the pronoun “we”) collects and processes, and for which purposes when you use our website. We are committed to protecting the privacy and security of our customers and site visitors. The following information will provide you with an easy-to-navigate overview of what will happen with your personal data when you visit this website. The term “personal data” comprises all data that can be used to personally identify you.

2 Data Processing on our Website

2.1 The data on this website is processed by the operator of the website, whose contact information is available under section “Legal notice” on this website.

2.2  Visiting our website, how do we record your data?

We collect your data as a result of your sharing of your data with us. This may, for instance, be information you enter into our contact form. Every time you use our website, we collect the access data automatically transmitted by your browser in order to make visiting the website possible. This access data includes in particular:

2.3  What are the purposes we use your data for?

A portion of the information is generated to guarantee the error-free provision of the website. Other data may be used to analyze your user patterns. We offer you the opportunity to send us messages directly by means of a contact form. This requires you to provide an email address where we can contact you. We also ask for your name so that we can address you. All mandatory fields are marked as such. We process the data you provide in the contact form in order to respond to your inquiry. The legal basis for this data processing is Art. 6 Sect. 1 lit. (b) DSGVO. The data collected when you use the contact form will be automatically deleted once we have finished processing your inquiry unless we still require your inquiry to fulfill contractual or legal obligations.

3  Hosting and Content Delivery Networks (CDN)

3.1  External hosting

This website is hosted by an external service provider (host). Personal data collected on this website are stored on the servers of the host. These may include but are not limited to, IP addresses, contact requests, metadata and communications, contract information, contact information, names, web page access, and other data generated through a website. The host is used for the purpose of fulfilling the contract with our potential and existing customers to Art. 6 Sect. 1 lit. (b) DSGVO and in the interest of secure, fast, and efficient provision of our online services by a professional provider (Art. 6 Sect. 1 lit. (f) DSGVO). Our host will only process your data to the extent necessary to fulfill its performance obligations and to follow our instructions with respect to such data.

3.2  Execution of a contract data processing agreement

In order to guarantee processing in compliance with data protection regulations, we have concluded an order processing contract with our host.

4  Your Rights

4.1  What rights do you have as far as your information is concerned?

You can unsubscribe at any time. A corresponding unsubscribe link can be found in every email or newsletter. It is of course also sufficient if you notify us using the contact details provided above or by emails, in the newsletter, and mobile push notifications if you have downloaded our app on your iPhone. The legal basis of the above processing is your consent pursuant to Art. 6 Sect. 1 lit. (a) DSGVO. You have the right to receive information about the source, recipients, and purposes of your archived personal data at any time without having to pay a fee for such disclosures. You also have the right to demand that your data be rectified or eradicated.

You have the right to information about how we process your personal data at any time. When providing this information, we will explain the data processing to you and provide you with an overview of the data stored about you. If data stored by us is incorrect or no longer up to date, you have the right to have this data corrected. You may also demand that your data be erased. Should the erasure not be possible in exceptional cases due to other legal regulations, the data will be blocked so that it is only available for that legal purpose.

You are also entitled to have the processing of your data restricted, e.g. if you believe that the data we have stored is incorrect. You also have the right to data portability, which means that on request we will send you a digital copy of the personal data you have provided. You can assert this right by contacting a supervisory authority in the Member State of your habitual residence, your place of work, or the place of the alleged infringement. The competent supervisory authority in Berlin is the Berlin Commissioner for Data Protection and Freedom of Information, Friedrichstr. 219, 10969 Berlin.

4.2 Right of withdrawal and objection

Pursuant to Art. 7 Sect. 3 DSGVO, you have the right to withdraw the consent you gave us at any time. As a result of this, we will cease the data processing based on this consent with future effect. This withdrawal of your consent will not affect the lawfulness of the processing carried out on the basis of the consent prior to the withdrawal. If we process your data on the basis of legitimate interests pursuant to Art. 6 Sect. 1 lit. (f) DSGVO, you have the right under Art. 21 GDPR to object to the processing of your data, and to give us reasons which arise from your particular situation which, in your opinion, show that your legitimate interests override ours. If your objection is to data processing for direct marketing purposes, you have a general right of objection, which we will implement without requiring you to give reasons. If you would like to make use of your right of withdrawal or objection, it is sufficient to simply notify us using the contact details provided above.

5  Data Recording on this Website

5.1  Cookies

Our websites and pages use what the industry refers to as “cookies.” Cookies are small text files that do not cause any damage to your device. This data is not merged with other data sources. This data is recorded on the basis of Art. 6 Sect. 1 lit. (f) GDPR. The operator of the website has a legitimate interest in the technically error-free depiction and the optimization of the operator’s website. 6  Analysis Tools and Advertising

6.1  Squarespace Analytics

This website uses Squarespace Analytics, a web analytics service provided by Squarespace Ireland Ltd., Le Pole House, Ship Street Great, Dublin 8, Ireland ("Squarespace"). Squarespace Analytics uses cookies to help the website analyze how users use the site.

The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Squarespace on servers in the United States. Our website uses the web analytics service Google Analytics, provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). According to Google, the contact for all data protection issues is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics uses cookies and similar technologies to analyze and improve our website based on your user behavior. On our behalf, the access data is combined by Google into pseudonymous user-profiles and transmitted to a Google server in the USA. Prior to this, your IP address will be anonymized. We are therefore unable to determine which usage profiles belong to a particular user. 6.3 Facebook Fanpage

We jointly operate a Fanpage on the social network of Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Irland (“Facebook”), where we communicate with interested parties and followers and inform them about our products and services. We may receive statistics from Facebook about how Facebook/Fanpage users use our Fanpage, such as information about interactions, likes, dislikes, comments, or aggregated information and statistics (such as the age or origin of our followers) that help us learn about interactions with our site. Further information on the respective legal responsibilities can be found in the Facebook Page Insights Controller Addendum. The legal basis for this data processing is Art. 6 Sect. 1 lit. (b) of the GDPR and 6 Sect. 1 lit. (f) of the GDPR based on our aforementioned legitimate interest.

We have no control over the data that Facebook processes on its own responsibility in accordance with Facebook’s terms of use. However, we would like to point out that when you visit the fan page, data on your usage behavior is transferred from Facebook and the fan page to Facebook. Facebook itself processes the aforementioned information in order to compile more detailed statistics and for its own market research and advertising purposes over which we have no control. If we receive your personal data while operating the Fanpage, you are entitled to the rights stated in this data protection declaration. If you also wish to assert your rights against Facebook, the easiest way to do this is to contact Facebook directly. Facebook knows the details of the technical operation of the platform and the associated data processing as well as the concrete purposes of data processing and can implement appropriate measures on request if you make use of your rights. We are happy to support you in asserting your rights to the extent possible and forward your requests to Facebook.

6.4 Other Social Media Channels

We maintain our online presence within social networks and platforms in order to communicate with you and inform you about our service. On our website, you will find links to our social media channels, identified by the respective logo of the service provider. By clicking on the logo you will be directed to the corresponding social media channel. The business conditions and data processing guidelines of the respective operators apply. We have no influence on the data processing by the respective service providers.

If you use the option to mark posts from us in our social media channels (e.g. by using the like-button) and/or to leave comments, these comments and marks are publicly accessible and your name and profile picture are associated with the mark and/or comment. You can remove your comments and marks at any time to the extent enabled by the provider of the social media platform. If you provide us with information via the social media channels we collect and process the data you voluntarily us with. The processing of your personal data is based on our legitimate interest in comprehensive information and communication with you in accordance with Art. 6 Sect. 1 lit. (f) DSGVO. If you are asked by the respective providers of the platforms for your consent to data processing, the legal basis for processing is Art. 6 Sect. 1 lit. (a) DSGVO.

7 Your Information and Countries

7.1 Online shops

Pixzam is a global business and you can’t buy anything directly in our free applications. It's your own choice of which online shop you prefer in your country for each product purchase with your personal data and country delivery options and costs. As a visual search distributor, we use global affiliate shopping link network programs (e.g. for ASOS, Amazon, Farfetch, Shopify, Etsy, Wayfair) officially registered in the US, Canada for North America, the UK, and Europe as you know from any online shop display advertising which you click on the internet. If you’re searching with our Pixzam “Best Price Cam App” within your region or click the “Top 10 products” on our website Pixzam.com we’re only linking into the online shops of your choice by clicking them, where you can buy these products then available – located across the world. Some of these online shop locations maybe will not offer the same level of protection for your personal data as in your country.

7.2 Affiliate networks

We share personal information with affiliate networks and their online shop partners when it is reasonably necessary or desirable, such as to help provide services to you or analyze and improve the services we or they provide.

7.3 Service providers

We share personal information with our service providers that perform services on our behalf. For example, we may use third parties to help us provide customer support, manage our advertisements on other sites, send marketing and other communications on our behalf or assist with data storage.

7.4 Business partners

We may share personal information with business partners. For example, we may share your personal information when our services are integrated with their third-party services, but only when you have been informed or would otherwise expect such sharing.
